PRINCIPAL TELECOMMUNICATIONS LEGISLATION The two main laws are the Telecommunications (Regulation) Act (Chapter 399 of the Laws of Malta) and the Malta Communications Authority Act (Chapter 418 of the Laws of Malta). The Telecommunications (Regulation) Act establishes the framework for a liberalised telecommunications market with regard to the authorisation of telecommunication services or systems, obligations on telecommunication operators and the protection of the interests of users. The Act provides for an Appeals Board to hear and determine appeals from decisions by the MCA and empowers the Minister responsible for communications to make regulations on various matters relating to telecommunications. There is also a right of appeal to the Court of Appeal on points of law decided by the Appeals Board. The Malta Communications Authority Act establishes the Malta Communications Authority and determines its powers and role as the competent authority responsible for the regulation of telecommunication services and systems in Malta.
